Terms and Conditions (Terms of Service) — Pawgevity

These Terms and Conditions ("Terms") govern access to and use of the Pawgevity website, operated by Luis Alonso Molina Castro (hereinafter, "we," "us," or "the Store"), as well as the purchase of products through it. By accessing the Site or placing an order, you accept these Terms in full. If you do not agree, please do not use the Site.

Pawgevity sells accessories and supplements for dogs. We operate under a dropshipping model, so products are shipped directly by external suppliers, which may be located in different countries.
2. Use of the Site
By using the Site, you agree to:
• Use it only for lawful purposes and in accordance with these Terms.
• Not engage in fraudulent activities or introduce malicious software.
• Not copy, reproduce, or exploit the content without authorization.
• Provide truthful and up-to-date information in your orders.
We reserve the right to suspend or restrict access to any user who violates these Terms.
3. User Account
You may purchase as a guest or create an account. If you create an account:
• You are responsible for keeping your credentials confidential.
• You are responsible for all activity carried out under your account.
• You must notify us immediately of any unauthorized use.
We may suspend or cancel accounts that violate these Terms or that are used fraudulently.
4. Products, Prices, and Availability
• Products are displayed as accurately as possible, but colors, sizes, and images may vary slightly from the actual product.
• Dog supplements are not medications and do not replace veterinary advice. Consult a veterinarian before administering them, especially if your pet has any health condition.
• Prices are displayed in US dollars (USD, $) and include or exclude taxes as indicated on the checkout page. Shipping costs are calculated before completing the purchase.
• We reserve the right to change prices and our catalog at any time without prior notice.
• Product availability is not guaranteed. Since we rely on external suppliers (dropshipping), a product may sell out or experience delays. If we are unable to fulfill an order, we will notify you and refund the corresponding amount.
• In the event of an obvious error in the price or description, we reserve the right to cancel the order and refund the amount paid.
5. Purchase Process
1. Select the products and add them to your cart.
2. Complete your shipping and billing information.
3. Review the order summary, shipping costs, and total.
4. Make the payment.
5. You will receive an order confirmation email. This email confirms receipt; it does not constitute final acceptance: the contract is finalized when we confirm shipment.
We may refuse or cancel orders due to lack of stock, pricing errors, suspected fraud, or the inability to ship to your area.
6. Payments
• We accept the payment methods indicated on the checkout page (card, and others as available).
• Payments are processed securely through external providers (for example, Shopify Payments, PayPal, Stripe). We do not store your full card details.
• The charge is made at the time of purchase. If the payment is declined, the order will not be processed.
7. Shipping, Timeframes, and Delivery
• Given the dropshipping model, delivery times may be longer than usual and may vary depending on the supplier and the country of origin of the product.
• Estimated timeframes are indicated on the shipping page and are for guidance only, not guaranteed.
• Duties, taxes, or customs fees may apply to international shipments and will be the customer's responsibility unless otherwise stated.
8. Exchanges, Returns, and Refunds
The conditions for exchanges, returns, and refunds are detailed in our Return/Refund Policy (available in the footer). Where the applicable law in Costa Rica recognizes a right of withdrawal, you will have the corresponding legal period to exercise it.
9. Intellectual Property
All content on the Site (logos, the "Pawgevity" brand, texts, images, design, graphics, and software) is the property of Luis Alonso Molina Castro or its licensors and is protected by intellectual property laws. Its reproduction, distribution, or commercial use without express written authorization is prohibited.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
• The Site and the products are provided "as is" and "as available."
• We do not guarantee that the Site will be free of errors or interruptions.
• We are not liable for indirect, incidental, or consequential damages arising from the use of the Site or the products.
• Supplements are sold as complements and do not guarantee specific health results. Their use is the responsibility of the pet owner, subject to prior veterinary consultation.
• Our total liability, to the extent permitted by law, will be limited to the amount paid for the order in question.
Nothing in these Terms excludes liabilities that cannot be legally limited.
11. Third-Party Links and Services
The Site may contain links to third-party sites or services (payment providers, social media, advertising platforms). We do not control and are not responsible for their content or their policies. Their use is governed by their own terms.
12. Indemnification
You agree to hold Luis Alonso Molina Castro harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Costa Rica. Any dispute arising from their interpretation or performance will be submitted to the competent courts and tribunals of Costa Rica, without prejudice to the rights that consumer protection regulations grant to the consumer.
14. Changes to the Terms
We may modify these Terms at any time. The version in effect will be the one published on the Site along with its update date. Continued use of the Site after a modification implies acceptance of the new Terms.
15. Partial Invalidity
If any clause of these Terms is deemed invalid or unenforceable, the remaining clauses will continue to be fully valid and enforceable.
16. Contact
Pawgevity is a store operated by Atlas Commerce, a registered e-commerce business in Costa Rica. All orders and payments are processed under Atlas Commerce.
